13 states sued the federal government this morning after President Barack Obama signed his Obamacare bill into law.
The AP reported:
Republican attorneys general from 13 states are suing the federal government to stop the massive health care overhaul, claiming it’s unconstitutional.
The lawsuit was filed immediately after President Barack Obama signed the overhaul bill Tuesday. It names the U.S. departments of Health and Human Services, Treasury and Labor.
Florida Attorney General Bill McCollum is taking the lead in the lawsuit. Attorneys general from South Carolina, Nebraska, Texas, Michigan, Utah, Pennsylvania, Alabama, South Dakota, Louisiana, Idaho, Washington and Colorado are joining in. Other GOP attorneys general may join the lawsuit later or sue separately.

The lawsuit was filed in Pensacola after the Democratic president signed the bill the House passed Sunday night.
“The Constitution nowhere authorizes the United States to mandate, either directly or under threat of penalty, that all citizens and legal residents have qualifying health care coverage,” the lawsuit says.
Yeah, that Barack Obama… He sure is a uniter.

What’s the Dems’ legal argument in favor of this mandate? See here for our previous discussion on the “General Welfare”, “Necessary and Proper”, and “Commerce” clauses of the Constitution. The bottom line is that they are warping the Constitution into a broken non-logic pretzel in order to even present an argument for these clauses; the plain reading and simple understanding of what these clauses actually mean and were meant to accomplish leaves no room whatsoever for such a mandate as health insurance.
Or, if you’re a powerful Democrat, you might rely on the good ol’ “Good and Welfare” clause, like this:
Just one little problem with that, as Hot Air explains:
There is, of course, no such thing as the Good and Welfare Clause, but if the chairman of the House Judiciary Committee can’t be bothered to read the bills he’s voting for, I guess it’s too much to expect him to read the Constitution too.
And thus we see the root cause of all the problems America faces today.
